Katadyn, Steripen and Optimus
Commercial Warranty Contract

1. General and statutory rights

Katadyn water filters, Steripen UV water purifiers and Optimus stoves are manufactured from high-quality materials and undergo quality control during production and before delivery.

Katadyn Produkte AG provides a voluntary manufacturer’s warranty against defects in materials and workmanship for the products specified below, subject to these conditions. No separate fee is charged for granting this warranty.

This warranty provides rights against the manufacturer in addition to any statutory rights you have against the seller. It does not replace, restrict or otherwise affect your statutory rights or any mandatory rights against the manufacturer.

Consumers in Germany and other EU countries may exercise their statutory rights concerning defective goods against the seller free of charge. You do not have to claim under this manufacturer’s warranty before exercising those rights.

For consumers in France, this warranty applies in addition to the statutory guarantee of conformity under Articles L.217-1 et seq. of the French Consumer Code and the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code. It provides a direct claim against Katadyn Produkte AG for covered defects and, where its duration exceeds the statutory conformity guarantee, additional coverage for the remaining warranty period.

For consumers in Switzerland, rights under applicable Swiss law and the sales contract remain unaffected. This warranty does not exclude or amend the seller’s liability for defects.

3. Covered products and scope

This warranty covers:

• Katadyn water filters, including the Katadyn Pocket Water Microfilter;

• Optimus stoves;

• Steripen UV water purifiers.

The product must have been purchased from an authorised retailer, distribution partner or an online shop operated by the Katadyn Group within the territory specified in Section 4.

The warranty covers defects in materials or workmanship that arise during the applicable warranty period under normal use and maintenance in accordance with the product’s operating instructions.

Chemicals, cleaning products, cookware, cutlery and food products are outside the scope of this warranty.

Normal wear and tear, including the normal consumption or deterioration of components during use, is not covered. Components subject to wear include filter elements, seals, pump leathers, water and fuel hoses, floats and prefilters.

A component is not excluded from coverage solely because it is subject to wear: a defect in its materials or workmanship remains covered under these conditions.

4. Warranty holder, duration and territory

a. Warranty holder and transfer

This warranty is granted to the original end customer who purchased the product. It is not transferable, except where applicable mandatory law provides otherwise.

Where French consumer law applies, a subsequent consumer owner who acquires the product from another consumer, whether by sale or gift, benefits from the remaining warranty rights as provided by law. Such a transfer does not itself restart the warranty period.

b. Duration and commencement

The warranty periods are:

The warranty period begins on the date of purchase by the original end customer.

These manufacturer’s warranty periods are separate from any statutory periods applicable to claims against the seller.

c. Territorial scope

This warranty applies to products purchased within the European Union, the other countries of the European Economic Area, or Switzerland.

5. Exclusions

This warranty does not cover defects or damage caused by:

• misuse, use outside the product’s intended purpose or excessive loading;

• failure to follow the operating instructions;

• improper cleaning or failure to perform the maintenance specified in the operating instructions;

• installation of incompatible replacement parts or accessories;

• modifications that cause the defect or damage;

• accidents, impact, dropping, negligent handling or other external damage;

• normal wear and tear.

An exclusion applies only to the extent that the relevant circumstance caused the defect or damage. An unrelated modification, maintenance omission or use of a replacement part does not automatically invalidate the entire warranty.

These exclusions do not limit any rights that cannot lawfully be excluded.

6. Making a warranty claim

To make a claim, contact one of the following:

• the retailer from whom you purchased the product;

• the Katadyn representative or distribution partner in your country, where available;

• Katadyn Produkte AG using the contact details in Section 2.

Provide a description of the defect and a legible proof of purchase identifying the product, purchase date and seller. A copy or electronic proof of purchase is acceptable.

Please contact the relevant service provider before sending the product so that you can receive suitable return instructions. The product must be made available for inspection and, where necessary, repair or replacement. Include the components reasonably required to assess the defect and follow applicable transport requirements.

Any mandatory rules concerning evidence and the burden of proof remain unaffected.

7. Warranty services and costs

For a covered warranty claim, Katadyn will repair the defective product or replace it with an equivalent model.

Where applicable mandatory law gives you a choice between repair and replacement, that choice will be respected, subject to the exceptions permitted by law. Otherwise, Katadyn may choose the appropriate remedy.

Repair or replacement will be completed within a reasonable time and without significant inconvenience. Where the warranty qualifies as a commercial durability guarantee under French law, the applicable statutory requirements apply, including completion of repair or replacement within 30 days of your request.

For covered warranty claims concerning products purchased in the European Union or the European Economic Area, repair or replacement is provided free of charge, including necessary transport, labour and material costs.

For covered warranty claims concerning products purchased in Switzerland, repair or replacement is provided without a service charge. The warranty holder bears the cost of sending the product to the warranty provider or the relevant service recipient, unless applicable mandatory law requires otherwise.

Services outside the scope of this warranty will only be charged following disclosure of the proposed costs and your agreement.

Parts or products replaced under this warranty become the property of Katadyn upon replacement, subject to applicable mandatory law.

8. Effect of repair or replacement on the warranty period

Unless applicable mandatory law provides otherwise, repair or replacement under this manufacturer’s warranty does not restart the warranty period. Replacement parts or products remain covered for the unexpired portion of the original warranty period.

Where French law applies, the remaining warranty period is suspended while the product is unavailable for a covered repair or replacement, until the repaired or replacement product is delivered to you. The suspension begins with your request for intervention or the date on which the product is made available for repair or replacement, whichever is more favourable to you.

The warranty period is also suspended during negotiations between you and the warranty provider aimed at reaching an amicable settlement, as required by French law.

Any further mandatory extensions, renewals or suspensions of warranty periods remain unaffected.
