Terms of service

Terms and Conditions

Katadyn Deutschland GmbH

This English version covers consumer orders placed with Katadyn Deutschland GmbH through the German online shop at katadyn.com. It contains the terms and conditions, separate withdrawal instructions and a model withdrawal form. The implementation notes at the end are for internal review and are not part of the customer-facing text. The contractual language in clause 3.8 remains German.

Before publication, the marked location of the online withdrawal function and the actual checkout and email processes must be checked. This is a draft and has not received final approval from legal counsel.

1 Scope

1.1 These General Terms and Conditions apply to contracts for goods concluded by consumers with Katadyn Deutschland GmbH through the German online shop at www.katadyn.com.

1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

1.3 These Terms and Conditions do not apply to orders placed with the French or Swiss companies of the Katadyn Group or through a separate B2B shop. The contracting party identified during the ordering process is the relevant seller.

1.4 The version of these Terms and Conditions incorporated when the order is submitted applies. Individually agreed terms take precedence.

3 Ordering and formation of the contract

3.1 The presentation of products in the online shop is an invitation to submit an offer and does not constitute a binding contractual offer by us.

3.2 You may add products to your shopping cart and enter your delivery and payment details during checkout. Before submitting your order, you may review your details and the selected products and amend them using the correction options provided during checkout.

3.3 By clicking the final order button, you submit a binding offer to enter into a contract for the products listed in your order summary.

3.4 You will receive an automated email acknowledging receipt of your order. This acknowledgement only confirms receipt of your offer and does not constitute acceptance.

3.5 The contract is formed only when you receive our separate order acceptance or dispatch confirmation by email, in which we expressly accept your offer.

3.6 The statutory provisions govern the period for acceptance. If we do not accept your offer in time or reject it, no obligation to pay arises under a purchase contract. Any amounts already collected will be refunded without undue delay, and any payment authorisations or holds will be released.

3.7 If an ordered product is unavailable before we accept your order, we will inform you. After the contract has been formed, your statutory rights in the event of delivery delays or unavailability remain unaffected.

3.8 The contractual language is German. We store the contract details and send you the contents of the contract, including the applicable Terms and Conditions and withdrawal information, by email no later than before the goods are delivered. We do not promise that the complete contract text will remain permanently accessible in a customer account. You may save or print the documents you receive.

4 Prices and shipping charges

4.1 The prices of goods shown in the online shop are stated in euros and include statutory VAT. The prices shown in your order summary when you submit your order apply.

4.2 For deliveries of goods within Germany, we charge a flat shipping fee of EUR 5.95 where the value of the goods ordered is below EUR 100.00. Delivery is free where the value of the goods ordered is EUR 100.00 or more.

4.3 The threshold for free shipping is calculated using the value of the goods after promotional discounts have been deducted. Shipping charges do not count towards the value of the goods.

4.4 The total price, including any shipping charges, is displayed before you submit your order. Further shipping information is available on the “Versand” (Shipping) page of the German online shop.

5 Payment

5.1 Payment is made in euros. We offer PayPal and the payment methods available at checkout through Shopify Payments, including credit cards, Klarna, Apple Pay and Google Pay. Payment on invoice is not offered.

5.2 The payment methods available for your order and their payment terms are displayed before you submit your order. Certain payment methods may be subject to requirements imposed by the respective payment service provider.

5.3 Payment processing depends on your chosen payment method. A technical payment authorisation or hold does not constitute order acceptance under clause 3.5. Payment processing does not affect your statutory consumer rights.

6 Delivery and damage in transit

6.1 Katadyn Deutschland GmbH delivers goods exclusively to delivery addresses in Germany. Goods are shipped by DHL.

6.2 Unless a different delivery period is stated for the relevant product, delivery takes 3 to 5 working days from formation of the contract. For this delivery period, working days are Monday to Friday, excluding public holidays at the place of dispatch or delivery.

6.3 For an order containing several products to be delivered together, the longest stated delivery period applies. The delivery period applicable to your order will be communicated before you submit your order. Partial deliveries will be made only where they are reasonable for you; they will not result in additional shipping charges.

6.4 We bear the risk of accidental loss of or damage to the goods during shipping until they are handed over to you or a recipient designated by you.

6.5 Please report any apparent damage in transit to us as soon as possible so that we can investigate with the carrier. Your statutory rights remain unaffected if you do not report damage immediately on delivery or accept the shipment without noting any reservations.

7 Retention of title

Delivered goods remain our property until payment has been made in full.

8 Statutory right of withdrawal

8.1 Consumers generally have a statutory right of withdrawal from distance contracts. Details are set out in the separate withdrawal instructions and the model withdrawal form.

8.2 You do not have to use the contact form, a returns portal or the model withdrawal form to exercise your right of withdrawal. An unequivocal statement addressed to us is sufficient. The statutory online withdrawal function is available as an additional method.

8.3 We bear the direct cost of returning goods when you exercise your statutory right of withdrawal. Please contact us to arrange a free return. Exercising your right of withdrawal does not require our prior approval.

8.4 In particular, the statutory right of withdrawal does not apply to goods that are liable to deteriorate or expire rapidly. It also does not apply to sealed goods that are unsuitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. These exceptions apply only where the relevant statutory requirements are actually met.

8.5 Food products, including freeze-dried meals and protein bars, are not excluded from the right of withdrawal merely because they are food. Opening ordinary packaging does not, by itself, exclude the right of withdrawal.

9 Voluntary return policy within 30 days

9.1 In addition to your statutory rights, we offer a voluntary right to return goods within 30 calendar days of receiving the respective goods.

9.2 This voluntary return policy requires the returned goods to be unused and complete, including all supplied accessories and components. For food products, the product packaging must be unopened and any product seals must be intact.

9.3 To meet the voluntary return deadline, it is sufficient to notify us of your return through the contact form or by email to info@katadyn.de within 30 calendar days of receiving the respective goods. You must then send the goods back within 14 calendar days of that notification. The return shipping deadline is met if you send the goods before that period expires. Please contact us to arrange a free return. Details of the procedure are available on the “Rückgaberichtlinie” (Return Policy) page.

9.4 We also bear the direct return shipping costs for returns under this voluntary policy. Return address: Katadyn Deutschland GmbH, Hessenring 23, 64546 Mörfelden-Walldorf, Germany.

9.5 Where the requirements are met, we refund the purchase price actually paid for the returned goods. Original delivery charges are not refunded under the voluntary return policy. The refund will be made no later than 14 days after receipt of the returned goods. We use the original payment method unless another method has been expressly agreed at no cost to you.

9.6 This voluntary return policy does not restrict your statutory right of withdrawal or statutory rights in respect of defective goods. In particular, the requirements that goods be “unused”, “complete” and in “unopened product packaging” do not apply as additional conditions for the statutory right of withdrawal. Statutory rights to reimbursement of delivery charges also remain unaffected.

10 Statutory rights for defective goods and voluntary guarantees

10.1 The statutory rights in respect of defective goods apply to defects in purchased products. Your contact for these rights is Katadyn Deutschland GmbH as the seller.

10.2 You are not required to inspect goods immediately on receipt or report a defect within three days in order to exercise your statutory rights. The original packaging is not required to exercise these rights.

10.3 Where a voluntary manufacturer’s guarantee is provided for a particular product, the terms of the respective guarantor apply. Information about the guarantor, duration, geographical scope, benefits, requirements and procedure is available with the relevant products and on the “Garantie” (Guarantee) page.

10.4 Voluntary guarantees do not affect your statutory rights. In the event of a defect, you may contact us regardless of whether a manufacturer’s guarantee exists or you make a claim under it.

11 Discount codes and promotions

11.1 Free promotional codes and promotions

Discount codes issued free of charge and promotions are subject to the promotional terms communicated before you submit your order, including their validity period, eligible products, minimum order value and whether they can be combined with other offers.

Discount codes must be applied during checkout before the order is submitted. They cannot be applied retrospectively to orders that have already been completed. This does not affect claims arising from an error in applying a code that was validly entered in time.

Discount codes cannot be redeemed for cash. In the event of a refund or reversal of a purchase, the amount actually paid is used as the basis. Your statutory right of withdrawal and rights in respect of defective goods remain unaffected.

12 Liability and product instructions

12.1 Our liability for loss or damage is governed by the statutory provisions.

12.2 Please follow the instructions for use, safety, storage and application provided for the respective product. For food products, please pay particular attention to ingredients, allergens, preparation, storage and shelf life. These instructions do not restrict statutory rights in the event of product defects or damage.

12.3 For biocidal products: Use biocides safely. Always read the label and product information before use.

13 Applicable law and consumer dispute resolution

13.1 The law of the Federal Republic of Germany applies. This choice of law must not deprive you of the protection afforded by mandatory provisions of the law of your habitual residence that would apply in the absence of this choice of law.

13.2 The statutory provisions on jurisdiction apply.

13.3 We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body.

Annex 1 Withdrawal instructions for goods

These instructions apply to purchases of goods.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period expires fourteen days after the day on which you, or a third party designated by you other than the carrier, acquire physical possession of the goods. If you have ordered several goods in a single order and they are delivered separately, the period begins on the day on which you or that third party acquire physical possession of the last item. If goods are delivered in several lots or pieces, receipt of the last lot or piece is decisive.

To exercise your right of withdrawal, you must inform us (Katadyn Deutschland GmbH, Hessenring 23, 64546 Mörfelden-Walldorf, Germany, telephone: +49 6105 456789, email: info@katadyn.de) of your decision to withdraw from this contract by an unequivocal statement, for example a letter sent by post or an email. You may use the attached model withdrawal form, but this is not obligatory.

You may also submit an unequivocal statement of withdrawal using the contact form on our website at www.katadyn.com. If you use this option, we will acknowledge receipt of your withdrawal by email without undue delay.

You may also exercise your right of withdrawal online at https://katadyn.com/en-de/pages/eu-withdrawal-form. If you use this online function, we will send you an acknowledgement of receipt on a durable medium, for example by email, without undue delay. This acknowledgement will include the contents of your withdrawal statement and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient to send your communication concerning the exercise of your right of withdrawal before the withdrawal period expires.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery charges, except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us, without undue delay and no later than fourteen days after the day on which we are informed of your decision to withdraw from this contract. We will make the reimbursement using the same payment method you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence that you have sent them back, whichever is earlier.

You must send back or hand over the goods to Katadyn Deutschland GmbH, Hessenring 23, 64546 Mörfelden-Walldorf, Germany, without undue delay and in any event no later than fourteen days after the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days expires.

We bear the cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

Exceptions to the right of withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are liable to deteriorate or expire rapidly, or to contracts for the supply of sealed goods that are unsuitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. Whether an exception applies depends on the statutory requirements for the respective product. Food products are not excluded as a general category.
